Violations of Civil, Criminal and Professional Codes

Residents of Paradise and Butte County must exercise extreme caution. Ferguson & Brewer Investment Co. has demonstrated a persistent pattern of conduct that violates California civil and professional codes, as well as specific criminal statutes. Management has consistently failed to maintain professional and legal standards, resulting in documented harm to residents.

1. Felony Conspiracy and Chemical Battery

The Incident: On Nov 24, 2025, the Broker and Lead Manager authorized a vendor to perform an un-notified chemical saturation of a private patio. This was executed despite the firm having explicit medical documentation on file regarding the resident's environmental sensitivities.

Legal Nature: This action constitutes a Felony Conspiracy (CA Penal Code § 182). The application of chemicals to a person's immediate living space without consent, causing physical distress, meets the criteria for Battery (CA Penal Code § 242).

*I have images, which include an admission of guilt by the lead manager for Ferguson & Brewer, where they state, "The vendor only wanted to make sure you didn't have further problems with the adjacent business complex (the source of the pests). He's sorry, and won't do it again." Clearly this was a complete saturation, NOT* "overspray" as the lead manager states. Complete saturation from gutters to ground. All over my personal property etc. Wet walls, ground, and chemicals beading on my therapy chair and windows. No mention of what chemicals were used or anything. Had my companion cat walked on this surface and groomed herself, she would be dead today!*

2. Retaliatory Characterization of Disability Crisis

The Incident: Following a medical crisis, the Lead Manager and Broker intentionally characterized a resident’s early morning panic and legitimate safety complaints as "harassment." Management used these communications as a pretext for retaliatory notices rather than providing mandated support.

Legal Nature: This is a Civil Rights Violation under the Bane Act (CA Civil Code § 52.1). Characterizing a disabled person’s symptoms as "harassment" to justify adverse action is a form of intimidation and violates FEHA protections.

3. Disability Discrimination and Habitability Failure

The Incident: During a 16-day period in August 2025, the residence was subjected to extreme environmental disturbances causing severe sleep deprivation. Despite knowledge of a disabled protected dependent adult in crisis, the Broker and Lead Manager refused a "Reasonable Modification" or rent abatement.

Legal Nature: This failure to accommodate violates ADA Title II standards. Refusing to abate rent when a dwelling becomes uninhabitable is a breach of the Implied Warranty of Habitability (CA Civil Code § 1941.1).

4. Predator Attractants and Public Safety

The Incident: Onsite Management has refused to address a free roaming feral/stray (tenant owned) cat population that serves as a primary attractant for coyotes. Scientific data indicates that cats comprise 20–29% of a coyote's diet in urban/suburban interfaces. These cats fight with my cat through the windows from the late evening until dawn, waking me and causing panic and hypertensive episodes.

Legal Nature: This constitutes a Breach of the Implied Warranty of Habitability (CA Civil Code § 1941.1). Allowing a known attractant for predators to persist creates a foreseeable risk to the safety and "quiet enjoyment" of the residents.

5. Professional Incompetence

The Incident: The firm has engaged in chronic unresponsiveness regarding a documented "Make-Whole" settlement intended to cover damages resulting from the aforementioned incidents.

Legal Nature: This reflects Professional Incompetence and Negligence (CA Business & Professions Code § 10177). The refusal to address a verified liability constitutes a failure of fiduciary duty.

The safety of the Residents of Paradise and Butte County depends on the accountability of its business leaders. Ferguson & Brewer Investment Co. has consistently demonstrated that they view legal and medical requirements as optional. This public record serves as a warning to the Residents of Paradise and Butte County and a formal notification of systemic failures. Vigilance is required when dealing with an entity that treats legitimate grievances and disability-related crises with retaliatory hostility. Avoid at all cost.

P.S. I have extensive evidence against this company, and will update this review as I see fit. The above are only a few of the issues I've had with this company since moving into one of their properties on February 26th, 2025. TrustPilot wouldn't allow me to enter that specific date.
