I've sponsored for my wife's spouse visa in Aug 2019 and got decision in Oct 2019 which was refused on the basis that I don't meet the financial requirements for this particular visa category due to my personal circumstances where I cannot work full time because I have to look after my 2 children aged 6 and 4. We decided to appeal against the decision which took about 13 months to be heard because of this Pandamic.
During this period I have sent both my children to Pakistan and started working full time so I can fulfill the financial requirements but I was still not meeting the income threshold. One of my children has got a health issue for which he was getting treated by NHS. My barrister made my appeal on Human Rights basis where he did not challenge the visa officer's initial decision which was surprising to me. On the hearing day the visa officer questioned every single bit which she thinks could justify her initial decision as they have to. It was my first time where I was questioned by a Judge and a visa officer on various things which I have little preparation and zero knowledge although I have provided them all the documents but I have no clue what they are going to ask me. Anyhow it took around 1 hour to complete the hearing and my barrister told me that we have put a strong case and hopefully our appeal will be granted which they say to everyone I presume. As I said it was my first appearance to these lot where I was not very hopeful because the body language of the Judge and the questions of the visa officer were very ruthless. Finally Judge took 35 days to make his decision which seems 35 months to me. In these long 35 days I use to curse everyone for nothing. Judge has APPROVED our appeal and granted visa.
All those my imprecations which I think were just my fear.
At the end it was better late than never kind of situation.
