Violated My Consumer Rights (Strange Tales To Collect)
This business violated my consumer rights even after being informed twice of their non-compliance with FTC Federal Regulation 16 CFR Part 435.
Here’s what happened:
On Sunday, March 22, 2026, I purchased a limited edition comic book from them and immediately emailed them to ask about shipping procedures.
On Monday, March 23, I emailed them again to ensure that the item was actually in stock to make sure I didn’t need to purchase it elsewhere before supplies ran out.
Neither email was replied to.
On Tuesday, March 24, I emailed them a third time to inform them I wished to cancel. Within five minutes I had a reply stating that they were too busy to reply and that they wouldn’t cancel. This is the key part: They then stated that the item would be shipped on Thursday (March 26). Their policy states “no change of mind” so I accepted that answer and moved on. Until…
On Thursday, March 26, the item never shipped. A shipping label had not even been created yet. The only correspondence I received from them was to say they were pulling the order to ship. But it didn’t.
According to the aforementioned federal regulation, if a merchant does not meet the promised ship date, they must do three things:
-Provide a notice of the delay
-Provide updated shipping information
-Provide the consumer with the option to cancel for a full refund
None of those criteria were met.
On Friday, March 27, I emailed them and informed them of their non-compliance with federal regulation, and that since my consumer rights were violated I wished to cancel the order again. I informed them that, should the package still ship, I would refuse delivery and do a chargeback.
I received a reply that they would not cancel the order because it shipped in a timely manner (completely disregarding consumer rights). At the time of their reply a label had just barely been created. It didn’t actually ship until Saturday, March 28.
This merchant had every opportunity to be a reasonable person. Instead, they chose to be stubborn and violate people’s rights. It was honestly like dealing with someone who has finally gotten a drop of power after a life of being bullied.
Their actions caused me to have to:
-File a dispute with my bank
-File a complaint with the FTC
-Reach out to their state’s Attorney General
