We purchased a 2-bed new-build flat in a block developed by GEM in 2021 - sourced by Property Hub Invest.

The flat, along with many other flats in the development, has had persistent condensation issues as well as other issues with fixtures and fittings.

Surveys have been conducted which found that the issues stem from construction defects.

We made numerous attempts to engage with GEM to address these defects. However, after some dismissive responses early on, they refused to engage constructively, leaving us no option but to take legal action.

I bought a 2-bed new-build flat in a block developed by GEM Construction back in 2021. Despite only being 3 yeas old, the property has had multiple problems, the most serious of which is excessive condensation which has returned each winter causing water damage and black mould to walls and skirting boards. When I reported the problem to GEM back in Dec 2021 and asked them to investigate, they refused. After 18 months of calling and emailing them but being ignored, I had to commission an independent survey. The surveyor, a damp specialist, conducted a comprehensive survey using specialist equipment. He provided evidence that the ventilation in the property is inadequate and does not meet the minimum required by Building Regulations. Since the issue is with the construction of the building, GEM, as the developer, are liable and are obliged by law to fix the issue and ensure the property meets the standards set out by the Building Regulations. When I reported this to GEM they said they would investigate but little came of this. I later discovered that 7 out of the 14 flats in the development have the same issue.

After endless emails and phone calls to them over the past 2 years, GEM have now stopped all communication with me and I am left with a damp, mouldy flat with inadequate ventilation.

A shockingly bad development and even worse customer service. I would certainly not recommend you buy any property in which GEM construction were involved.

Poor quality build on the new build North Lodge York. Massive issues with condensation and ventilation. Properties with excessive damage to skirting boards, walls with excessive black mould. GEM has ignored letters and emails and won't do anything. Insurance that was provided by builder does not cover the shoddy workmanship. Notice has been given to carry out the repairs necessary to put things right but has also been ignored. No alternative but court action.
