Seeing is believing
Dear Sir/Madam,
This email sets out my final position regarding order #29390, placed in May 2026.
1. The order was not delivered within a reasonable time despite repeated follow-ups on my part. PayPal adjudicated the resulting non-delivery dispute in my favour, and the full purchase price, including air freight, was refunded. The contract was thereby cancelled. The relevant dates are a matter of record in PayPal's case file.
2. The parcel arrived only after the order had been cancelled and refunded. I did not request delivery of a cancelled order and have no obligation to pay for it.
3. Responsibility for the failed delivery is a matter between you and your chosen carrier. USPS was selected and paid by you; your remedy lies in a claim against USPS, not in a demand against me. In a consumer mail-order transaction, the risk of non-delivery rests with the seller — which is precisely why PayPal found in my favour.
4. Without any obligation to do so, I have kept the item safe and unused. I repeat my offer: the jacket is available for collection, at your arrangement and expense, until 16 August 2026. If collection has not been arranged by that date, I will treat the item as abandoned and will dispose of it as I see fit, without further liability to you.
5. Any invoices, payment demands, or PayPal money requests will be declined. If you consider that you have a claim against me, you are free to pursue whatever remedies you deem appropriate.
This is my final correspondence on this matter.
Regards,
Vincent Kong
