Ware nie erhalten, widersprüchliches Tracking und trotzdem wochenlang kein Geld zurück
Ich habe bei CHARLES & KEITH über den österreichischen Shop bestellt und die Ware bis heute nicht erhalten. Das Paket blieb nachweislich im Zoll hängen. Im Tracking wechselte der Status zwischen „Pending Customs“, „Parcel is being returned“ und anschließend wieder „Held in Customs“. Eine Zustellung oder auch nur ein Zustellversuch bei uns hat nie stattgefunden.
Besonders problematisch: CHARLES & KEITH übermittelte uns später eine Information des Versanddienstleisters, laut der der Empfänger das Paket angeblich verweigert habe. Das entspricht nicht den Tatsachen. Niemand von uns hatte das Paket jemals in der Hand und niemand konnte es daher ablehnen. Nach Auskunft des Zolls lag das Problem vielmehr darin, dass offene Einfuhrthemen auf Versenderseite nicht geklärt wurden und der Versender offenbar nicht erreichbar war.
Trotzdem will CHARLES & KEITH die Erstattung davon abhängig machen, dass das Paket zunächst irgendwann im eigenen Lager ankommt, dort bis zu 14 Werktage geprüft wird und anschließend nochmals bis zu 14 Werktage für die Rückzahlung vergehen können. Im schlechtesten Fall soll der Kunde also viele weitere Wochen auf sein Geld warten, obwohl er die Ware nie erhalten hat und keinerlei Kontrolle darüber besitzt, wo sie sich befindet.
Nach meiner Auffassung steht dieses Vorgehen bei einem Verbraucherkauf über den österreichischen Shop nicht im Einklang mit den einschlägigen österreichischen und europäischen Verbraucherschutzbestimmungen. Das Transportrisiko verbleibt grundsätzlich beim Händler, bis der Verbraucher die Ware tatsächlich physisch erhalten hat. Genau das ist hier nie geschehen. Nachdem feststeht, dass die Bestellung nicht mehr geliefert wird und der Vertrag wegen Nichtlieferung beendet wurde, sehe ich auch keine Grundlage dafür, die vollständige Erstattung weiterhin von internen Lager- und Prüfprozessen abhängig zu machen. Wir haben CHARLES & KEITH deshalb unter Bezugnahme auf § 7b und § 7c KSchG sowie Art. 18 und Art. 20 der EU-Verbraucherrechte-Richtlinie zur unverzüglichen vollständigen Rückzahlung aufgefordert.
Es geht hier nicht nur um eine verspätete Lieferung. Es geht um eine nicht erhaltene Bestellung, objektiv widersprüchliche Versandinformationen, eine nachweislich falsche Behauptung über eine angebliche Annahmeverweigerung und den Versuch, das gesamte Transport- und Rückabwicklungsrisiko auf den Kunden abzuwälzen.
Der Kundenservice hat bislang keine angemessene Lösung angeboten, sondern lediglich lange interne Bearbeitungsfristen genannt. Eine sofortige Erstattung wurde trotz Nichtlieferung nicht bestätigt. Sollte die Rückzahlung nicht unverzüglich erfolgen, bleibt nur noch ein Chargeback über Mastercard und die Weitergabe an die zuständigen Verbraucherschutzstellen.
Stand 10.08.2026 ist der Vorgang ungelöst. Aufgrund dieser Erfahrung kann ich von einer Bestellung bei CHARLES & KEITH derzeit nur abraten.

Gorgeous products, slightly slow delivery
The items I'd ordered are beautiful, and exactly as expected. The only slight issue was that one was delivered from the UK (so arrived very quickly) and the other from Hong Kong - which took about a week longer. It was for a birthday present and thankfully arrived just in time but I wasn't aware on ordering that they would come separately and that the smaller item was going to take longer. In the end all was fine, but maybe just telling customers an expected delivery date per item not for the whole order would be helpful.

Horrible Customer service. I emailed their support team over and over and over again and they never respond. Stole £75 and won't help me. I ordered on the 22nd and it's been 2 weeks of radio silence. No support.
